1. Scope

These General Terms and Conditions apply to all orders placed through the online shop ashanddusk.com. By completing an order, you agree to these GTC.

2. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. By submitting your order, you make a binding offer. The contract is concluded when we confirm your order by email or dispatch the goods.

3. Prices and Payment

All prices are stated in the displayed currency. Payment is made via the payment methods offered at checkout (e.g., Shopify Payments, credit card). The invoice amount is due immediately.

4. Delivery

We deliver worldwide. The estimated delivery time is 7–20 business days, depending on the destination country. Products are shipped directly from our fulfillment partner. Delivery delays due to customs, force majeure, or external circumstances are beyond our control.

5. Customs and Import Duties

Our products are shipped internationally, usually from China. Customs duties, import taxes, or other charges may apply upon import into your country. These costs are not covered by us and are to be borne by the buyer. The amount of charges depends on the respective destination country and is beyond our control. We recommend that you inform yourself about this with the relevant customs authorities in your country before placing an order.

6. Retention of Title

The delivered goods remain our property until full payment has been received.

7. Right of Withdrawal and Returns

Customers within the EU and EEA have the legal right to withdraw their order within 14 days of receipt without giving any reason.

For customers in Switzerland, there is no statutory right of withdrawal. However, we voluntarily grant a 14-day right of return from receipt of the goods. Details can be found in our Return & Refund Policy.

8. Data Protection

The collection and processing of your personal data are carried out in accordance with our Privacy Policy. By using our shop, you agree to the data processing described therein.

9. Warranty and Liability

The statutory warranty rights apply. Our liability for slight negligence is excluded to the extent permitted by law. This does not apply to damages resulting from injury to life, body, or health.

10. Applicable Law and Jurisdiction

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is Goldingen, Switzerland, as far as legally permissible. For consumers within the EU, mandatory consumer protection provisions of the respective country of residence remain unaffected.

11. Dispute Resolution

The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr. We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board.
