1. Principle

The protection of your personal data is important to us. We process your data exclusively on the basis of legal provisions, in particular the EU General Data Protection Regulation (GDPR) and the Swiss Data Protection Act (DSG).

2. Collection and processing of personal data

When you place an order in our shop, we collect the following data, which are necessary for the fulfilment of the contract:

– Name and address
– Email address
– Phone number (optional)
– Payment information
– Order data

The legal basis for processing is Art. 6 para. 1 lit. b GDPR (contract fulfilment).

3. Disclosure to third parties and data transfer to third countries

To fulfil your order, we pass on your delivery and order data to our fulfilment partner CJDropshipping. CJDropshipping is based in China and processes your data exclusively for order processing and shipping. When transferring to this third country outside the EU/EEA, we cannot guarantee a level of data protection comparable to that of the EU. The transfer is based on Art. 49 para. 1 lit. b GDPR (contract fulfilment) and is absolutely necessary for processing your order. Further information can be found at cjdropshipping.com.

Payment processing is handled via Shopify Payments. Your payment data is transmitted directly to the payment provider and is not stored by us. Further information can be found in Shopify's privacy policy at shopify.com/legal/privacy.

4. Cookies

Our shop uses cookies – small text files that are stored on your device. Technically necessary cookies (e.g. shopping cart, checkout, session management) are set on the basis of Art. 6 para. 1 lit. f GDPR (legitimate interest) and do not require separate consent.

For customers from the EU, we obtain your consent via our cookie banner before non-essential cookies are set. You can withdraw your consent at any time. Cookies can also be deactivated in your browser, which may, however, limit the functionality of the shop.

5. Hosting

Our shop is hosted on the Shopify Inc. platform (151 O’Connor Street, Ground floor, Ottawa, Ontario, K2P 2L8, Canada). Shopify processes data on our behalf in accordance with applicable data protection regulations. Further information: shopify.com/legal/privacy.

6. Storage period

We store your data only for as long as it is necessary for contract fulfilment or legal retention periods exist (usually 10 years for accounting documents).

7. Your rights

You have the right to information, rectification, erasure, restriction of processing, and data portability. You also have the right to object to processing. To exercise your rights, please contact hello@ashanddusk.com.

If you believe that the processing of your data violates data protection law, you have the right to complain to a supervisory authority – in Switzerland to the Federal Data Protection and Information Commissioner (FDPIC) or in the EU to the competent national data protection authority.

We reserve the right to adapt this Privacy Policy if necessary, e.g. if new services are added. The current version will always be available on this page.
